A personal injury claim exists when someone else’s failure to use reasonable care causes you harm. The label on the accident matters less than the conduct behind it, because Idaho decides every one of these claims on the same four questions.
What You Must Prove to Win an Idaho Injury Claim

Partly at Fault for Your Injuries? You Can Still Recover Under Idaho Law
Idaho follows a modified comparative negligence rule with a 50 percent bar. Under Idaho Code § 6-801, you can recover compensation as long as your share of fault is less than 50 percent, and your award is reduced by your percentage. The math is plain: if a jury sets your damages at $100,000 and finds you 20 percent at fault, you collect $80,000. At exactly 50 percent, you recover nothing, because the statute requires your fault to be strictly less than the other side’s.
One sharp edge worth knowing: Idaho compares your fault against each defendant individually, not against all defendants combined. Adjusters know these rules and use them, because shifting blame onto you is the cheapest way to shrink a claim. What Your Garden City Injury Claim Is Worth
Idaho law splits recoverable damages into two categories, and a complete claim documents both.
Economic damages are the losses with a dollar figure attached:

The cap does not apply where the conduct was willful or reckless, or would constitute a felony, and economic damages are never capped.

The Deadlines That Control Your Claim
Two years. Under Idaho Code § 5-219(4), you must file a personal injury lawsuit within two years of the date you were hurt. The clock starts on the day of the occurrence, not the day you discovered the harm. Idaho has no general discovery rule for personal injury, and continuing symptoms do not extend the deadline.
Two more deadlines catch people off guard:
- Property damage, three years. Claims for damage to your vehicle or other property fall under Idaho Code § 5-218.
- Government claims, 180 days. If a city, county, or state entity caused your injury, the Idaho Tort Claims Act requires a written notice of claim within 180 days of the date the claim arose or reasonably should have been discovered. Miss the notice window and the claim is barred, no matter how much time remains on the two-year statute.
When a lawsuit becomes necessary, a Garden City injury case is filed in Idaho’s Fourth Judicial District at the Ada County Courthouse, 200 West Front St. in Boise, because Garden City has no separate district courthouse.
